I had not expected our legislature to be in session Saturday, Sunday and the Monday of the labor day weekend, but they were. Unfortunately, rather than use this time to pass the most critical legislation, like a state budget, they were focused on dozens of other bills.
One piece of legislation in particular disturbed me,
SB 981 (Perata). On the surface, this bill seems like a good idea. When patients must see a healthcare provider in an emergency, they shouldn't have to pay thousands of dollars extra if that provider is not contracted with the patient's health plan. I agree, but existing law already protects patients; the health plans must pay. The health plans make a financial choice not to contract with certain doctors and hospitals and collect money in advance specifically to pay for an expected number of out-of-network payments. In other words, the health plans know they occasionally have to make these payments and already built those increased costs into the premiums they charged you and your employer. Unfortunately, rather than enforce the law and force health plans to pay, the legislature believes that socialist price fixing, which has worked so well for Medicaid patients (not!), should be applied to all patients.
If the Governor signs this legislation, he will be the first governor in the country to support price fixing of any industry which is not a monopoly. Worse, he will be the first governor to do so specifically to increase the profits of another private, for-profit corporation rather than require corporate responsibility. He will literally cause the taking of money from those who actually provide services to patients, and give it to the middlemen who provide no service. Does that sound like a principle worth supporting? Should we do the same for electricians, plumbers, small business owners, and actors? I don't think so. What do you think?
